1. About Us & Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user", or "customer") and Balu Ram Rajeshwar Kumar, a proprietary firm operating under the brand name "Annapurna Spices" (referred to as "we", "our", "us", or "Annapurna Spices"), having its principal place of business at Shop No. 2486, Gurudwara Road, near Singh Sabha, Anand Colony, Neelpur, Rajpura, District Patiala, Punjab – 140401, India.

By accessing this website, our WhatsApp Business channel, our social media handles, our mobile interfaces, our retail counter, or any other point of contact operated by us, you acknowledge that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy, Refund & Cancellation Policy, and Data Deletion Policy. If you do not agree, you must stop using our services immediately.

2. Eligibility

You represent and warrant that:

• You are at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872.
• You are not barred or disqualified from receiving products or services under any applicable law of India.
• The information you provide during registration, checkout, or communication is true, accurate, current, and complete.

3. Account Registration & Security

• You may sign in via email, mobile OTP, or third-party providers we support (e.g. Google).
• You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account.

• We reserve the right to suspend, restrict, or terminate any account at our discretion if we suspect fraud, misuse, abuse, or violation of these Terms.

4. Products, Pricing & Availability

• All products are subject to availability. We reserve the right to limit quantities, modify product specifications, or discontinue any item without prior notice.
• Product images, weights, and packaging on the website are illustrative. Actual products may vary slightly due to natural variation in raw materials, harvest cycles, and packaging revisions.
• Prices are listed in Indian Rupees (INR) and are inclusive of GST unless stated otherwise. Shipping, handling, and other charges are shown at checkout.
• If a price, weight, MRP, or stock indication is displayed incorrectly due to typographical, technical, pricing-engine, or human error, we reserve the right to cancel the affected order, even after acceptance, with a full refund of any amount already paid.
• Promotional codes, festive offers, dealer discounts, and bundle prices are valid only as per the conditions specified at the time of the offer and may be withdrawn or modified at any time.

5. Order Acceptance & Contract

Submission of an order, whether through our website, WhatsApp, marketplace listing, or telephone, constitutes an offer by you to purchase. The contract of sale is concluded only when we issue an order confirmation (by email, SMS, or WhatsApp). Until such confirmation, we may decline the order without liability. Payment authorisation alone does not constitute order acceptance.

6. Payments

• Payments are processed through third-party PCI-DSS compliant gateways. We do not store full card numbers, CVVs, UPI PINs, or net-banking credentials.
• You agree to comply with the applicable terms of the payment service you choose. We are not liable for failures, declines, or chargebacks attributable to your bank or payment provider.
• In case of suspected fraud, we may delay dispatch, request additional verification, or cancel the order without prior notice.

7. Shipping & Delivery

• We ship through reputed logistics partners. Delivery timelines are estimates and not guaranteed; they may be affected by location, weather, festivals, courier capacity, or events outside our control.
• Risk of loss and title pass to you upon delivery to the address provided. You are responsible for ensuring availability at delivery and providing correct contact details.
• Re-attempt and re-shipment charges arising due to incorrect address, refusal to accept, or non-availability after multiple attempts are payable by you.
• For marketplace orders (Amazon, Flipkart, JioMart, Blinkit, etc.), the marketplace's shipping and delivery terms shall additionally apply.

8. Returns, Cancellations & Refunds

Returns, cancellations, and refunds are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Because our products are perishable food items, certain restrictions apply for hygiene and food-safety reasons.

9. WhatsApp & Order List Feature

• By using our "Add to List" or "WhatsApp Order" features, you authorise us to receive and process the resulting message and the data it contains for the purpose of preparing your order.
• WhatsApp messages are governed additionally by Meta's terms and policies; standard mobile-data and SMS rates may apply.
• Marketing or promotional WhatsApp messages will be sent only after you opt in. You may opt out by replying "STOP" or by writing to us.

We disclaim all liability for outcomes arising from reliance on such content.

11. Intellectual Property

The Annapurna Spices brand, logos, packaging artwork, product descriptions, recipe content, photographs, videos, illustrations, MaAI prompts, and all software components on this website are owned by Balu Ram Rajeshwar Kumar or duly licensed to us. They are protected by Indian and international copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, transmit, modify, scrape, frame, mirror, sell, or create derivative works from any portion of our content without our prior written consent.

20. Governing Law & Dispute Resolution

Subject to the Consumer Protection Act, 2019, the courts at Rajpura / Patiala, Punjab shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of our services.
